Conservation Commission Meeting Minutes

OPENING: The regular scheduled meeting of the Conservation Commission opened at 7:00 p.m.  Attendance is as follows:

7:03    Seth Kellogg, Vice Chairman, opened the meeting.
MINUTES
Commissioner MacWilliams made a motion to accept the minutes of 10/03/16.  Commissioner Mizanoglu seconded the motion.  None opposed, motion passed unanimously.

 

HEARINGS

 

7:16 42 Powder Mill Road – RDA Continuation

 

Jon Goddard, R. Levesque
Mr. Goddard presented a minor revision to the plans along the cul-de-sac.  The location of the silt fence was delineated to accommodate a different location of the pedestals for the light poles located in the buffer zone.  There will also be two light poles installed adjacent to the softball field in what is currently the lawn section.  The DEP had no comments on the proposal.   Mr. Goddard stated that the work should be completed before April 2017 depending on the severity of the winter season.  
Commissioner MacWilliams made a motion for a negative determination.  Commissioner Kellogg seconded the motion.  None opposed, motion passed unanimously.

Chairman Pratt opened the hearing by reading the notice as posed in the Westfield Evening News.  Mr. Houoi presented a plan showing the dwelling location and the wetlands.  Silt fencing will be installed on both sides of the construction area.  There is also a man made swale the slopes to the west side of the property.  Mr. Pari had changed the original plans to move the garage to the front of the dwelling so the side buffer area will not be impacted.  The property does contain a high water table.  Coordinator Clark stated that the DEP had not issued their number prior to the start of this meeting.  Mr. Hoxha requested that the meeting be continued until such time as the DEP number is available.   Commissioner Kellogg made a motion for a continuation.  Commissioner Pranka seconded the motion.  None opposed, motion passed unanimously.  The hearing closed at 7:45 p.m.
 
BUSINESS

 

LPP Application  Commissioner MacWilliams made a motion to table this issue until the next scheduled meeting on November 7th.  Commissioner Pranka seconded the motion.  None opposed, motion passed unanimously.

 

Certificate of Compliande DEP 292-285   Coordinator Clark stated that there was no new information on this case.
 
107 Point Grove Road – Tree removal  Coordinator Clark stated that there is no new information on this issue at this time.

 

Lakemont Street – Brush trimming  Commissioner Clark stated that the property owner requested a meeting in November to discuss the issue.

 

107 South Loomis – Potential enforcement  Coordinator Clark related an email from David Cameron, DEP, stating that they intend to move forward with an enforcement approach that has the Conservation Commission members in the lead.  DEP will provide technical support, an interpreter to ensure there is no miss understanding, and would be the enforcement authority.  A meeting will be scheduled in November.  The Conservation Commission members will need to do a follow up on the case to ensure the property owner does fulfill the corrective actions.  

 

129 North Lake Avenue  Coordinator Clark received a letter from DEP concerning the Chapter 91 application for a dock exceeding 600 square feet at this location.  The DEP issued a finding that the application is administratively deficient per the minimum standards required of a Waterways License application in accordance with 310 CMR 9.11 (3)(a), (b) and (c).  The letter also noted that the dock appears to exceed the boundaries of the property in accordance with the Assessors records.  Coordinator Clark stated that there is a potential for issuance of a fine, or removal of the dock.
