Board of Health Meeting Minutes

OPENING:  The regular scheduled meeting of the Board of Health opened at 7:00 p.m.  The following members were in attendance:
Dr. Jerome Azia
Sue Brzoska
Casimir Tryba

 

Mr. Thomas FitzGerald, Health Director, was also in attendance.

 

Also in attendance was:
Mr. Deedy, Selectman
Mr. Moglin, Selectman
Mr. Gary Porter, a resident to observe meeting procedures

 

MINUTES
Ms. Brzoska made a motion to approve the minutes of January 21, 2016.  Dr. Azia seconded the motion.  The vote of the Board was unanimous as amended.

 

MR. FITZGERALD’S REPORT
2 Lakemont Street  Mr. FitzGerald reported that the owner of the property does not have the funds to pay the water bill.  The Housing Court case was postponed until February 22nd.

 

26 Point Grove Road  Mr. FitzGerald reported that the tenants did clear some of the debris.  Mr. FitzGerald will continue to monitor the property.

 

7 Buckingham Road  Mr. FitzGerald reported that the tenant is no longer in residence.  Septic system repair plans have been approved.  The property owner will have two years in which to complete the repairs which will be in June 2017.  The code violations have been corrected and dismissed in Housing Court without prejudice.

 

3 Bakers Shore  Mr. FitzGerald received a call from the owner of the property concerning flood insurance.  There is a second floor apartment with two bedrooms above the garage that was not permitted.  Mr. Lawler issued a notice to the owner that the apartment must be evacuated within 30-60 days.  The septic system for the property was not designed for the additional bedroom apartment.

 

Mr. FitzGerald received a call from the Fire Chief concerning a lift assist at Depot Court.  The patient, who is a smoker, was not transported.  Chief Anderson was concerned with the conditions inside the residence as there was no safe disposal method of smoking materials.  Mr. FitzGerald contacted Mr. Dan Kelly, Director, Westfield Housing Authority, who stated that he was aware of the problem and will follow up with his staff.

 

Mr. FitzGerald conducted a site visit at Beast Coast Vapors due to the lack of information on his business certificate.  There have been no permits issued by the Board of Health for the business.  The owner had left a message stating that he would contact Mr. FitzGerald, but as of this meeting, there has been no additional contact.  Mr. FitzGerald will issue a second certified letter requesting information and contact information.  The business is in a residential dwelling.

 

Mr. FitzGerald will extend an invitation to Dr. Lester Hartman to attend a Board of Health meeting to discuss the hazards youth access of nicotine delivery products (NDP) inclusive of E cigarettes and raising the age to purchase NDP products to 21.

 

Mr. FitzGerald reported that only three businesses did not pay for their food permit in accordance with the new regulations.  All three have since paid for the permits with additional fines.

 

Mr. FitzGerald presented a draft of the Annual Town Report for the Board members review.

 

Mr. FitzGerald conducted a site visit with Mr. Dennis Clark, Conservation Commission, concerning a beaver dam on Granville Road.  The dam is causing a culvert to flood and the dam will be destroyed.  

 

Mr. FitzGerald conducted a pool inspection at Wilderness Experience.  The focus of the business has been redirected to bicycles.

 

Mr. FitzGerald and Dr. Azia will attend the Finance Committee meeting for the fiscal year budget 2017 on Saturday Feb 6th at 8:00 am.

  • New King Yen Too – Mr. FitzGerald presented photographs of the restaurant showing the numerous sub-standard conditions in the kitchen.  A letter was issued on July 28th concerning cleanliness, but conditions have since declined.  Ms. Brzoska made a motion to fine the establishment $250.00 in accordance with the new Food Service Regulations and have the owner hire a consultant within 7 days.  In the event the owner does not contact the Board of Health office with the name of the consultant by the 16th of February, the business will be closed.   Mr. Tryba seconded the motion.  The vote was unanimous in favor.
