Board of Health Meeting Minutes

OPENING:  The regular scheduled meeting of the Board of Health opened at 7:00 p.m.  The following members were in attendance:
Dr. Jerome Azia
Sue Brzoska
Jean Nilsson


 

Mr. Tom FitzGerald, Health Director, was also in attendance.

 

MINUTES

 

Mrs. Nilsson made a motion to accept the minutes of 05/04/17.  Dr. Azia seconded the motion.  The vote was unanimous in favor.

 

Mrs. Nilsson made a motion to nominate Dr. Azia as the Chairman of the Board of Health.  Dr. Azia seconded the motion.  The vote was unanimous in favor.
 
MR. FITZGERALD’S REPORT

 

9 Foster Road Mr. FitzGerald stated that the case was continued until May 30th.  A receiver as appointed, but the mortgage holder may have some interest in making the necessary repairs.

 

18 Eagle Street  Mr. FitzGerald reported that a receiver was appointed by Housing Court.  Mr. FitzGerald and Mr. Lawler, Building Inspector, conducted a joint inspection of the dwelling and found a dead raccoon in the basement along with clothing and other debris.  The receivership will document the extent of the repairs needed.  The owner’s heir will have a chance to return to the property to claim personal items.

 

8 Curtis Road  Mr. FitzGerald  conducted a site visit and found a large amount of debris.  The property owner is in the process of clearing the debris.  Mr. FitzGerald will re-inspect the site.

 

33 Buckingham Drive  Mr. FitzGerald spoke to the property owner concerning code violations on the exterior of the property after receiving a complaint from a neighbor of unregistered vehicles.  The property owner stated that he would bring the property up to code and intended to gut and rehab the dwelling.
 
82 North Lake Avenue  Mr. FitzGerald stated that a neighbor complained of a tarp being used as fencing on the property.  There were no other relative Board of Health issues on the property.  Mr. FitzGerald referred the situation to the Building Inspector.
 
15 Fernwood  Mr. FitzGerald received a complaint from the South View Condominium Association concerning offending materials on the property abutting the condominiums.  Mr. FitzGerald talked to the owner who stated that he would remove the materials.
 
150 Vining Hill Road  Mr. FitzGerald stated that the property owner was adding a second floor extension designed for 3 bedrooms.  The additional bedrooms would require an update to the septic system.  A percolation test was not able to be performed due to ground water.  The property owner revised the building permit from additional bedrooms.  Mr. FitzGerald will continue to monitor the status of the septic system expansion per Title 5.

 

61 Hastings Road  Mr. Pinell issued an email to various departments and boards based on a complaint of the lawn not being mowed, and there appears to be no evidence of occupancy.  Mr. FitzGerald did not find any evidence of trash, nor has any complaint been issued to the Board of Health.

 

39 Sam West Road  Mr. FitzGerald and Mr. Lawler conducted a site visit at the location for a alleged illegal business on the property.  The owner does not have permits for the vehicle repair/painting operation, but stated that he would go to the Planning Board and the Zoning Board of Appeals for permits.

 

224 Vining Hill Road  Mr. FitzGerald stated that a receivership is reviewing the property at the request of the Attorney General’s Office.  The property has been vacant for some time.  The Attorney General’s Office is preparing to bring the issue before Housing Court.

 

14 Oak Street  Mr. FitzGerald reported that there have been tenant/landlord issues on this property since 2012.  The tenant has since moved, but the case was never dismissed.  Town Counsel will issue a formal report to Housing Court.

 

38 Lakeview Street  Mr. FitzGerald was informed that the property owner stopped paying the court ordered payment for the water bill.  The owner was supposed to pay $50.00 every two weeks, or $100.00 a month.  Michelle Hill advised Mr. FitzGerald that only two payments were made, and will forward same to the Housing Court Judge.  

 

Mr. FitzGerald issued an emergency trapping out of season beaver permit for Hastings Road.  

 

Mr. FitzGerald will attend FDA 2013 code revision training on May 23 & 24.  The 2013 Food Regulations have not as yet been adopted in Massachusetts, but their adoption is likely.
