7:00pm Meeting was called to order by Chairman Chris Pratt.
7:07 DEP Emergency Regulations 310 CMR 10.62 for October Snowstorm discussed. Commissioners decide not to revoke regulation by November 30th as allowed by the DEP. Commission adopts policy under Local Bylaw to visit sites claiming storm damage before work is performed even though the regulation does not require it.
7:15 The Conservation Restriction submitted to the Commission from Attorney Buckley for Whalley Park was reviewed before the next meeting potential vote scheduling.
7:21 Joe Scuderi has applied to the DEP for a Chapter 91 licenses for docks at Crabby Joe’s, and is asking for the Commission’s blessing. Commissioners request that Mr. Scuderi remove the existing rotting and decrepit docks before winter. Mr. Scuderi agreed to remove docks and come back to the Commission after the docks are removed.
7:36 Lake Management Committee requested that the Commission to review potential revisions to the Lake Bylaws with paying special attention to the need for retaining 76-2-N, as the Board of Selectman had discussed removing it from the warrant article. The Chair requested that the Selectmen provide them with reason for removal of 76-2-N.
7:44 The Sofinowski ten-year Forest Management Plan is due to be updated. The Commission had a request from the Open Space and Planning Committee to transfer the sum of ($1000.00) one thousand dollars to have a comprehensive Forest Management Plan produced. It is acknowledged that this action could potentially help in obtaining future grants for the property.
A motion was made by commissioner David Stansbury to approve the transfer of funds from the Land Management Account to forester Jeff Jordain, who has been working with the SOSPC, after the Commission approves a completed Forest Management Plan. Commissioner Seth Kellogg seconds the motion. No one opposed. Motion passed unanimously.
Chair for The Open Space Committee John Stadnicki proposed that a “closed for the season” sign be posted on the gate of the Granville Gorge for the winter months.
Motion made by commissioner Seth Kellogg to approve the transfer of funds to purchase a “Closed” sign and approve closing the Gorge for the winter months. Commissioner James Parent seconds the motion. No one opposed. Motion passed unanimously. John Stadnicki who is currently managing the Gorge has agreed implement the action.
7:51 20 The Commission had requested in writing, with the threat of fines for non-compliance, several times an as-built plan and guarantee of as good or better than designed Storm-Water System for 20 Depot Square Condominium Project. A letter from RLA about why they haven’t been able to comply with the Commission’s requests was handed out to commissioners. The issuing of Certificate of Occupancies for the newly constructed condos by the Building Inspector was questioned. The Developer now has been in non-compliance with the Commission in regards to this most recent ongoing three hundred dollar a day violation as of November 7, 2011.
8:01 On-going 63 Foster Rd. violation. Landowner working with R. L. Levesque on restoration plan that must be implemented during the summer months which are least susceptible to weather conditions.
Lakeview St. Map 114 Parcel 99 dock had been removed by Mr. Tom Swain as requested by Commission. Ownership of the property was unclear at this time. Commissioner Baribeau volunteered to investigate and determine ownership of the property to see if it is legal for resident to put dock there.
9:00 Motion made by Commissioner Parent to close the meeting. Commissioner Stansbury seconds the motion. No one opposed.
