MINUTES
BOARD OF HEALTH
January 19, 2012

OPENING:  The regular scheduled meeting of the Board of Health opened at 7:00 p.m.  The following members were in attendance:
Dr. Jerome Azia
Sue Brzoska
Casimir Tryba

Mr. Tom FitzGerald, Health Director, was also in attendance.

MINUTES

Ms. Brzoska made a motion to accept the minutes of December 15, 2011.  Mr. Tryba seconded the motion.  The vote of the Board was unanimous in favor.

Ms. Liuntas and Mr. Tsaviois attended the meeting to discuss the opening of their restaurant The Proud Chief at 784 College Highway.  Mr. FitzGerald had issued a letter to Ms. Liuntas on December 5th, which she claims was never received.  The letter contained a food establishment plan review guide specifying the requirements needed before the restaurant could open.  Ms. Liuntas stated that the kitchen will remain basically the same as the previous business.  Mr. Tryba noted that as new owners, the kitchen will need to conform to current regulations, inclusive of a hand washing sink that was missing from the plans.  The Board members agreed that Mr. Tryba, being the member most knowledgeable of food related issues, would review the submitted kitchen design with Mr. FitzGerald for conformity.  Mr. FitzGerald will then contact Ms. Liuntas on Monday January 23rd.  Ms. Liuntas did present a sample of their menu and stated that food has already been delivered to the location.  

MR. FITZGERALD’S REPORT

156 Berkshire Avenue Mr. FitzGerald reported that the property owner who resides in Connecticut has not made any progress to repair electrical, hearing and structural issues.  A Housing Court date has been set for January 23rd.

628 College Highway  Mr. FitzGerald reported that the code violations have been corrected.

28 Deer Run  Mr. FitzGerald was informed of a large quantity, one million gallons, of water usage at the property.  Mr. FitzGerald conducted a site inspection and noted that the property was vacant.  At this time, there is no explanation for the excessive water usage.

7 Deer Run  Mr. FitzGerald received a call from the mortgage holder of the property who was lead to believe that there was someone lining in the dwelling.  A large amount of debris from the October snow storm has not been removed from the property.  Mr. FitzGerald conducted a site inspection and found no evidence of occupancy, and further discovered that there has been no water usage at the location since October 2011.  The information was related back to the mortgage holder who stated a work order will be issued to clear the debris.

46 Klaus Anderson Road  Mr. FitzGerald informed the property owner that the shed is in disrepair.  The property owner asked if he could just remove one wall of the structure and asked for more time.  Due to the condition of the structure, the Board members were not in agreement to a time extension or a partial removal as a shed is not allowed on a property without a dwelling.

48 Rosewood  Mr. FitzGerald was informed by Deborah King, Social Services, that the fire exits are open in the residence.  The owner has recently been receiving medical care.  Mr. FitzGerald will continue to monitor the situation.

Mr. FitzGerald is completing an application for a possible summer intern.  Mr. Fitzgerald stated that the student could help in planning a program for an emergency shelter and a way to comply with the new sharps disposal regulations to take effect on July 1st.

Mr. Fitzgerald petitioned the Board members to consider changing his title to be more consistent with his actual duties.  Mr. FitzGerald is now a Health Agent, but requested that the Board consider the title of Health Director.  Ms. Brzoska made a motion to change Mr. FitzGerald’s title.  Mr. Tryba seconded the motion and the vote of the Board was unanimous in favor.

Mr. FitzGerald received an anonymous complaint of an unpermitted septic system repair at 21 South Loomis Street.   Mr. FitzGerald did conduct a site investigation and found a basis for the complaint.  The septic system repair was to replace the tank.  The installer did appear at the Board of Health office to take the installer’s exam, and then uncovered the repair work for Mr. FitzGerald’s inspection.

Mr. FitzGerald asked the Board to consider composing a new septic system installer’s exam.  The current exam is antiquated and does not reflect the many changes in Title 5.  The Board agreed with Mr. FitzGerald’s observation, and concluded that other regulations will need to be reviewed as well.

Mr. FitzGerald stated that Mr. Grannells requested a joint meeting with the Board of Selectmen and other Board’s and Committees inclusive of the Board of Health to discuss keeping the lake clean.  

FOOD INSPECTIONS

  • King Yen Too - Mr. FitzGerald conducted an inspection of the restaurant and was not satisfied with the conditions.  A subsequent inspection showed improved conditions.  Mr. FitzGerald will continue to monitor the restaurant.
  • Tractor Supply - Mr. FitzGerald received an anonymous complaint concerning food service at Tractor Supply.  An investigation concluded that the manager had given a holiday gathering where cheese and crackers were served without the use of gloves.  As the situation was in essence a private party for employees and not a public event, Mr. FitzGerald took no further action.

The Board of Health is scheduled for their budget hearing on Feb 4 at 11:05 am.

The Board of Health received a Public Notice for a proposed by-law amendment.

The Board of Health received a request for the annual report to be submitted by February 3rd.
