MINUTES
BOARD OF HEALTH
January 24, 2008



OPENING:  The regular scheduled meeting of the Board of Health opened at 7:00 p.m.  The following members were in attendance:
Dr. Jerome Azia
Sue Brzoska
Casimir Tryba


Mr. Tom FitzGerald, Health Agent, was also in attendance.

MINUTES

1.      Mr. Tryba made a motion to approve the minutes of 01/03/08.  Ms. Brzoska seconded the motion and the vote of the Board was unanimous in favor.

MR. FITZGERALD'S REPORT

1.      Mr. Neece advised Mr. FitzGerald that the floor drain by-law would be presented at a Town meeting.  The Board of Health will sponsor the by-law, and the Plumbing Inspector will be responsible for the inspections.  The Board is still awaiting a review of the by-law from Town Counsel.

2.      Mr. FitzGerald reported that the State now issues Massage Regulations to the practitioners in Southwick.  As the State now licenses the facilities, some of the business owners and therapists have requested a rebate of the license issued by the Board of Health for 2008.

3.      Mr. FitzGerald reported that the Building, Plumbing and Building Inspectors have reviewed the OWFF Regulations.

4.      Mr. FitzGerald witnessed a third percolation test at 75 Fred Jackson Road.

5.      Mr. FitzGerald reported that the Housing Court cases for 623 College Highway and JPK Enterprises have been dismissed and upon advise of Town Counsel are now being tried as civil cases.

6.      Mr. FitzGerald reported that the buildings at 5 and 9 Lakeview Street have not been board and secured.  Mr. FitzGerald will file at Housing Court for the property.

7.      Mr. Fitzgerald will inspect the food distributors for the Penguin Plunge.  All of the activities for this year's event will be held out doors.

8.      Mr. FitzGerald received a complaint of a septic smell at 100 Fred Jackson Road.  There was no evidence of a break out of the system during a site visit, and the complainant stated that the smell was only interminent.  Mr. FitzGerald requested that the complainant notify him when the smell is evident so he may conduct another site investigation.

9.      Mr. FitzGerald stated that a meeting with the Board of Selectmen and the Fire Chief would be held to review the fire procedural protocol.

10.     Mr. FitzGerald presented a license for Lisa Anderson for an installers' permit.  Mrs. Anderson did have a passing grade, but administers the test for the Board of Health.  The Board members agreed that issuing a permit to Mrs. Anderson would be a conflict of interest.

11.      Mr. FitzGerald submitted a draft of the annual Town report for the Board members to review.

12.     Mr. FitzGerald reported that the budget hearing for the Board of Health would be held on February 9th at 10:10 am.  

13.     Mr. FitzGerald will attend a training seminar for infectious disease.  Ms. Brzoska made a motion for the $35.00 fee to be paid out of the Board of Health budget.  Mr. Tryba seconded the motion and the vote of the Board was unanimous in favor.  Mr. FitzGerald will also attend two WMPHA meetings for well regulations and court filing procedures.

14.     Mr. FitzGerald reported that he and Jay Mustain conducted deep hole investigations at Wynnfield Condominiums.  The reason for the five of the six septic system failures is not conclusive.  A possible explanation could be that paint and dry wall during construction material could have entered the leach fields, thus blocking the natural percolation.  The septic tanks are being pumped on a regular basis.

MAIL

1.      The Board reviewed plans for the Southwick Inn and Walt's Garage.  The proposal is for a new kitchen facility and increased parking.  There will be a hearing for the proposal on January 29th at 7:30 pm.

2.      The Board received a report from Aquatic Control Tec on the results of the lake treatment.

As there was no further business to be brought before the Board, the meeting adjourned at 8:30 p.m.
