BOARD OF HEALTH

June 21, 2007

 

 

 

OPENING:  The regular scheduled meeting of the Board of Health opened at 7:00 p.m.  The following members were in attendance:

Dr. Jerome Azia

Sue Brzoska

Casimir Tryba

 

Mr. FitzGerald, Health Agent was also in attendance.

 

MINUTES

 

1.          Ms. Brzoska made a motion to accept the minutes of June 7th, 2007.  Mr. Tryba seconded the motion and the vote of the Board was unanimous in favor.

 

MR. FITZGERALD’S REPORT

 

1.          Mr. FitzGerald met with the elderly owner of the property at 787 College Highway on June 14th.  Some progress has been made to clear the debris from the property.  Mr. FitzGerald did attend a Housing Court hearing on June 18th at which the court issued a criminal complaint for the next date in court.  In the event the property is not cleared, a criminal complaint can be issued through Housing Court.

 

2.          Mr. FitzGerald reported that Town Counsel had issued letters to everyone not connected to the public sewer system.  The Board did review the minutes of September 16 and October 7, 2004 concerning the waiver for 5 Ridge Road.  The time period for the waiver has expired. 

 

3.          Mr. FitzGerald reported that the Town Beach would open the weekend on June 23rd.  The first water sample was 6 for ecoli.

 

4.          Mr. FitzGerald received a complaint concerning Nora’s restaurant.  The restaurant will be inspected during business hours.

 

5.          Mr. FitzGerald advised the owner of 35 Ed Holcomb Road to obtain a Title 5 inspection for his septic system, and continue to pump the tank to prevent sewage from surfacing.

 

6.          Mr. FitzGerald attended a department head meeting.

 

7.          Mr. FitzGerald completed his NEMA training for ICS 300 (Incident Command System).  The training focused on managing an event or disaster in conjunction with the Fire and Police Departments.

8.          Mr. FitzGerald conducted a food service inspection at Jimmy’s Pizza – no issues were noted.

 

9.          Mr. FitzGerald received a request for a letter from the Board of Health to Mr. Misischia stating that all of the issues on his property at 50 Hastings Road have been resolved.  Mr. FitzGerald will conduct a site visit on the property then make his recommendations to the Board concerning the letter.

 

10.     Mr. FitzGerald noted that the well regulations did not specifically mention “irrigation wells”.  The installations of wells require a completion report that must be sent to the State with a copy to the Board of Health.  Mr. FitzGerald will review the existing regulations and research the various testing procedures for all types of wells.

 

11.     Mr. FitzGerald signed Disposal Works Construction Permits for the following locations:

1)     11 Fred Jackson Road

2)     3 Stage Coach Road

3)     35 Berkshire Avenue

4)     85 Mort Vining Road

5)     28 Crystal Drive

 

12.     Mr. FitzGerald witnessed percolation tests at the following locations:

1)     Lot # 4, 5, 2, 13, 26 Noble Steed

Some of the percolation sites on Noble Steed are off site of the actual lot boundaries.  Mr. FitzGerald will research Title 5 to determine if the percolation tests locations would be allowed.

2)      3 Stage Coach Road

3)     135 Granville Road

4)     185 Feeding Hills Road

5)     Lot A Sheep Pasture Road

6)     28 Crystal Drive

7)     6 Mockingbird Lane

8)     Lots # 20, 21, 25 Buckingham Drive

 

13.     Mr. FitzGerald conducted a final inspection of the septic system installations at the following locations:

1)     6 Shaggbark Drive

2)     Lot 1 Gableview

 

DISCUSSION

 

The Board members discussed the on going situation of restaurant closings mandated by the Board of Health.  It was determined that police officers do not have to enforce Board of Health orders.  However, Dr. Azia did request a memorandum of understanding from the Board of Selectmen.  The Board of Health will also consider raising fines as a deterrent in the event a restaurant owner refused a demand for closure.

 

 

 

 

 

 

As there was no further business to be brought before the Board, the meeting adjourned at 8:30 p.m.
